Most likely it will not be considered marital property, unless husband contributed to buyout or upkeep of the property.

Were any expenses (buyout, renovations, utility bills etc.) for the apartment paid with husband's, or with joint marital funds? If not, then, most likely it is not a marital property, at least not in our state (MA).
