вопрос
кто оплачивает так называемый декрет?
у нас 5 офисов в разных штатах, сегодня моя начальница говорила с бухгалтерией (они в Нью Джерси), так сказала, что компания не оплачивает декретный отпуск, должен оплатить Department of Labor
я вообще даже не подразумевала, что он должен платить, я всегда думала, что компания платит
позвонила в наш в Хьюстоне, мне так и сказала, что это между мной и компанией
в Нью Джерси в нашем офисе девочке декрет оплачивал Department of Labor, 12 недель....
т.е. в каждом штате по разному или все от компании зависит?

Well, FMLA is federally mandated and they should care to be in compliance with federal law, that's for sure.

Employees are eligible for leave if they have worked for their employer at least 12 months, at least 1,250 hours over the past 12 months, and work at a location where the company employs 50 or more employees within 75 miles. Whether an employee has worked the minimum 1,250 hours of service is determined according to FLSA principles for determining compensable hours or work.

The author of the post did not give you any information to show that she does not qualify for FMLA.

No company wants to be in non-compliance over FMLA and similar laws, so it is normal for someone in HR to actually keep the full record and know vulnerabilities.

When the author said that her employer will not even look into FMLA, I suspect that they know that she is not eligible.

Yes, FMLA is there only to protect your job, nothing else.
